GENERAL TERMS AND CONDITIONS
These General Terms and Conditions (“Terms”) govern access to and use of the website www.justlust.nl (the “Website”) and the services offered through it.
The Website is operated by a company incorporated under the laws of the Netherlands and registered with the Dutch Chamber of Commerce under number: _______ (the “Operator”, “we”, “us”, or “our”).
By accessing or using the Website and/or its services, you (“User”) agree to be legally bound by these Terms and the applicable Privacy Policy. If you do not agree, you must immediately cease using the Website.
1. Definitions
For the purposes of these Terms:
Account means a registered user profile granting access to certain Website functionalities.
Advertiser means any natural or legal person offering erotic and/or sexual services via the Website.
Advertisement means any listing published on the Website promoting erotic and/or sexual services, including related images, audiovisual materials, and descriptions.
Visitor means any natural person accessing or browsing the Website.
Services means the intermediary online platform services provided through the Website.
User means any Visitor or Advertiser.
Website means www.justlust.nl and all associated subdomains.
2. Applicability
2.1 These Terms apply to all use of the Website and Services and to all agreements between the User and the Operator.
2.2 Any general terms and conditions of the User are expressly rejected unless agreed in writing.
2.3 The Operator reserves the right to amend these Terms at any time. Continued use after publication of amendments constitutes acceptance.
2.4 If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force.
3. Nature of the Services
3.1 The Website functions exclusively as an online intermediary platform enabling Advertisers and Visitors to connect in relation to lawful erotic and sexual services.
3.2 The Operator acts solely as a neutral technical service provider. The Operator is not a party to any agreement between Users and is not involved in any services offered or performed by Advertisers.
3.3 The Operator does not guarantee the accuracy, completeness, legality, or reliability of User-generated content.
3.4 Use of the Website is at the User’s own risk. Availability and uninterrupted operation are not guaranteed.
4. Eligibility and Account Registration
4.1 Visitors must be at least 18 years of age. Advertisers must be at least 21 years of age.
4.2 The Operator reserves the right to verify identity and age and may request official identification documentation.
4.3 Users must provide accurate, complete, and current information when registering.
4.4 Each User may hold only one Account unless explicitly authorized. Account credentials are personal and non-transferable.
4.5 Users are fully responsible for all activity conducted under their Account.
5. User Obligations and Prohibited Content
5.1 Users must comply with all applicable laws and regulations.
5.2 Users warrant that content published on the Website is lawful and does not infringe third-party rights.
5.3 Prohibited content includes, but is not limited to:
Any material relating to illegal prostitution, trafficking, coercion, or exploitation
Content involving minors or persons under 21 years of age
Defamatory, discriminatory, violent, or threatening material
Malware, automated scripts, or harmful software
References to competing platforms
5.4 The Operator may remove or suspend content or Accounts at its sole discretion without prior notice.
6. Zero Tolerance Policy
6.1 The Operator maintains a strict zero-tolerance policy regarding illegal activity, coercion, exploitation, or abuse.
6.2 Access may be terminated immediately where unlawful conduct is suspected, and authorities may be notified where appropriate.
6.3 Users are encouraged to report suspected illegal activity to the Operator and/or relevant authorities.
7. Data Protection
7.1 Personal data is processed in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and applicable Dutch data protection laws.
7.2 Where acting as data controller, processing is governed by the Privacy Policy.
7.3 Appropriate technical and organizational measures are implemented to safeguard personal data.
7.4 Personal data will not be transferred outside the European Economic Area without adequate safeguards.
8. Intellectual Property
8.1 All intellectual property rights relating to the Website remain the exclusive property of the Operator or its licensors.
8.2 Users retain ownership of their own content but grant the Operator a non-exclusive, transferable, sublicensable, royalty-free license to use such content for operation and promotion of the Website.
8.3 Users indemnify the Operator against claims arising from content they publish.
9. Liability
9.1 To the fullest extent permitted by law, the Operator excludes liability for indirect or consequential damages, including loss of profit, revenue, data, or reputation.
9.2 Total liability is limited to direct damages not exceeding EUR 25 per incident.
9.3 Nothing excludes liability arising from intentional misconduct or gross negligence where such limitation is prohibited by law.
10. Paid Services
10.1 Advertisers may purchase enhanced placement services for a fee.
10.2 All prices are stated in euros and include VAT unless otherwise specified.
10.3 Credit bundles are non-refundable, non-transferable, and expire upon termination of the Account.
11. Reviews
11.1 Visitors may submit reviews where enabled. Reviews are subject to moderation.
11.2 The Operator reserves the right to remove reviews at its discretion.
11.3 Users are solely responsible for review content.
12. Termination
12.1 Agreements are concluded for an indefinite period.
12.2 Users may terminate at any time by deleting their Account.
12.3 The Operator may suspend or terminate access immediately in case of breach or legitimate grounds.
13. Governing Law and Jurisdiction
13.1 These Terms are governed by Dutch law.
13.2 Disputes shall be submitted exclusively to the competent court in The Hague, the Netherlands.
13.3 Consumers may alternatively use the EU Online Dispute Resolution (ODR) platform.
